This Comun Referral Program (the "Program") is offered and administered by Comun, Inc. ("Comun"). Community Federal Savings Bank ("CFSB"), Cross River Bank ("CRB") and any other third party are not sponsors, administrators or parties to this Program. Service UniTeller, Inc., which provides international remittances, is also not a sponsor, administrator or party to this Program. This Program is not a product or service of CFSB or CRB.
Comun is a financial technology company and not a bank. Banking services for the Comun DDA are provided by Community Federal Savings Bank, Member FDIC. Funds in a Comun DDA are FDIC-insured up to applicable limits only against the failure of CFSB. FDIC insurance does not protect against the failure of Comun. Comun is provided by Cross River Bank through the ComunPay service, for which Comun, Inc. acts solely as CRB's agent. Funds in Comun are held by CRB in an omnibus custody account for the benefit of Comun holders. Funds in Comun are not FDIC-insured. The Referrer Credit is a promotional credit offered by Comun. It is not a deposit, is not held at CFSB or CRB, and is not FDIC-insured.
These terms and conditions (the "Terms") govern participation in this Program offered by Comun, effective [date]. The Program will continue until Comun establishes an end date.
The Program is available to eligible Comun holders. To be eligible, a Referrer must hold an approved, open Comun in good standing. A person who holds any other account offered through Comun is not eligible to participate in this Program as a Referrer.
"Comun DDA" means the demand deposit account established by CFSB and serviced by Comun.
"Participant" means a Referrer or a Referee.
"Referee" means an individual referred to Comun by a Referrer through the Program.
"Referrer" means an eligible Comun holder who shares their unique invitation link under the Program.
"Comun holder" means a person who holds an approved and open Comun, which is provided by CRB through the ComunPay service and serviced by Comun, Inc.
Capitalized terms defined elsewhere in these Terms (including "Qualifying First Remittance," "Successful Referral" and "Referrer Credit") have the meanings given to them there. Undefined terms have their ordinary meaning.
For each Successful Referral (as defined in Section 3), the Referrer will receive a credit of ten U.S. dollars ($10.00 USD) to use toward future international remittances sent through the Comun app ("Referrer Credit"). Comun may change the amount of the Referrer Credit for future referrals by updating these Terms. The amount that applies to a referral will be the amount in effect on the date the Referee signs up using the Referrer's invitation link, and will not be reduced for that referral by any later change.
This Program does not provide a reward to the Referee. The Referee may be eligible for other current Comun promotions, subject to their own terms. Except as expressly stated by Comun, the Program may not be combined with any other offer.
A "Qualifying First Remittance" is the first successful, non-reversed international remittance sent through the Comun app by the Referee and funded from their Comun or Comun DDA, for an amount equal to or greater than fifty U.S. dollars ($50.00 USD) (amount sent, excluding fees).
NON-qualifying transactions:
(a) Remittances that are canceled, refunded, rejected or not completed
(b) Remittances that are later reversed, returned or charged back within sixty (60) days
(c) Remittances below the minimum amount stated above
(d) Any transaction other than an international remittance
A referral is considered a "Successful Referral" when all of the following conditions are met:
(a) The Referee is new to Comun, has never held a Comun or Comun DDA, and signs up using the Referrer's unique invitation link, shared from the Comun mobile app or WhatsApp;
(b) The Referee opens a Comun or Comun DDA and successfully completes the approval process;
(c) The Referee completes a Qualifying First Remittance; and
(d) No fraudulent, abusive or self-referral activity is detected.
Only referrals initiated with the link generated on the referral screen of the Comun app or on WhatsApp are eligible.
Comun may verify the Referrer's eligibility and compliance with these Terms before granting any Referrer Credit. The Referrer Credit will be automatically added to the Referrer's promotional credit balance in the Comun app within two (2) business days after a Successful Referral is verified, provided the Referrer's Comun or Comun DDA is open and in good standing at that time.
The Referrer Credit applies to the total amount the Referrer pays for the next remittance. It will be shown as a discount on the remittance screens before the remittance is confirmed. If a remittance on which Referrer Credit was used is canceled, refunded or not completed, the Referrer Credit used will be restored to the Referrer's credit balance. The Referrer may use a maximum of twenty-five U.S. dollars ($25.00 USD) of credit per remittance. The remaining balance stays available for future remittances.
The Referrer Credit is not cash and cannot be withdrawn, transferred or exchanged for money, and can only be used for remittances sent through Comun. The credit balance is kept if the Referrer converts their Comun to a Comun DDA. The credit does not expire while the Referrer has an open Comun or Comun DDA in good standing. Any unused Referrer Credit will be forfeited if the Referrer no longer has an open Comun or Comun DDA, or as provided in Section 6.
Participation in the Program does not guarantee approval of any application for a Comun or Comun DDA. Approval is subject to identity verification, compliance, eligibility, risk review, the applicable bank's policies, and legal requirements.
A Referrer may receive Referrer Credits for a maximum of ten (10) Successful Referrals in any rolling period of 365 days, counted from the date each Referrer Credit is granted.
Additional Successful Referrals beyond the tenth (10th) within that period will not generate a Referrer Credit. The limit applies to credits granted, not to the number of times the Referrer shares their link.
A person can only be referred once.
Referrers may only refer family members and personal friends. Referrers must not post or distribute their referral link in public places (online or otherwise) where the audience is likely to include people who are not family members or personal friends.
Expressly prohibited actions:
(a) Self-referral, including when the Referrer and the Referee are the same person, share the same device, share the same identity documents, or are otherwise controlled by the same person
(b) Using robotic, repetitive, automated, programmed, script-based, macro-based or other automated means to generate referrals
(c) Using multiple email addresses, phone numbers, identities, registrations or logins to generate referrals
(d) Any activity that Comun reasonably considers to be fraud, abuse or a violation of these Terms, including the use of false or fictitious names during registration
Comun reserves the right to deny, withhold, revoke, reverse or recover any Referrer Credit, including any unused balance, within sixty (60) days after the Successful Referral if any of the actions described in this Section 6 is detected, if the Qualifying First Remittance is later canceled, refunded, reversed, returned or charged back, or if the Referrer's or Referee's Comun or Comun DDA is closed, suspended, restricted or otherwise not in good standing. Comun may also disqualify any Participant from this Program and from future Comun promotions. Any action affecting a Participant's Comun or Comun DDA will be taken under the terms governing that account.
When a Referee signs up using a referral link, Comun will ask the Referee for consent to share the status of the referral with the Referrer. That information is limited to the Referee's first name, whether the Referee has completed sign-up, and whether a Referrer Credit has been earned. Comun will not share any other information about the Referee's Comun, Comun DDA, balances or transactions.
The collection, use, storage and processing of any personal data will be governed by Comun's Privacy Policy.
This Program is not transferable. The Program is available to U.S. residents who are eighteen (18) years of age or older.
Referral invitation links do not expire unless Comun ends the Program or the Referrer's Comun is closed, in which case unused referral links will become invalid.
Comun reserves the right to end, suspend, modify or cancel the Program at any time, including in the event of technical failure, fraud, abuse, operational error, regulatory changes or other circumstances beyond its control, to the extent permitted by applicable law. Comun's computer systems will be the official timekeeping device for the Program. If the Program ends or is modified, Referrer Credits already earned will be honored for any Successful Referral where the Referee signed up before the change and completes a Qualifying First Remittance within sixty (60) days after the change, and existing Referrer Credit balances will remain available for use for at least 90 days after the Program ends.
Comun may modify these Terms at any time. Any modification will be effective upon posting the revised Terms on Comun's website or mobile app and will not reduce Referrer Credits already earned or adversely affect referrals where the Referee signed up before the modification.
By participating, each Participant agrees that Comun, CFSB, CRB, and their respective affiliates, directors, officers, employees, contractors and agents are not responsible for: (a) technical failures of any kind; (b) lost, delayed, incorrect or undelivered communications; (c) system errors, human errors or operational issues; or (d) any injury, loss, claim or damage arising from participation in the Program or use of any Referrer Credit, except to the extent such limitation is prohibited by applicable law.
The value of any Referrer Credit may constitute taxable income. Participants are responsible for any applicable taxes. Where required by applicable law, Comun may issue an IRS Form 1099 for Referrer Credits and may request the Referrer's taxpayer identification number before issuing further Referrer Credits.
Any dispute related to referral attribution or Referrer Credit eligibility must be submitted to Comun's customer service team within thirty (30) days after the date of the applicable Qualifying First Remittance or Referrer Credit. Comun will review the request and respond in writing. This section applies only to referral attribution and Referrer Credit eligibility. It does not limit any error resolution rights a Participant has under applicable law for a remittance, Comun or Comun DDA.
The Program and these Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
